Interview with John Patzakis, Founder and CEO of X1 Discovery

Thu, 05/17/2012 - 23:01

John, the last time you were interviewed at Forensic Focus you were the Vice Chairman and Chief Legal Officer at Guidance Software. Now you're the founder and CEO of X1 Discovery - tell us about that move. I am proud to have been a co-founder and part of the senior team at Guidance Software for ten years. The early days at Guidance were exciting as we sowed new fields, just as we are doing now at X1 Discovery. At Guidance, we first pioneered Windows-based forensics, which was the new paradigm and represented an order of magnitude improvement over Dos-based forensics. Then circa 2004, we introduced and championed the concept of enterprise in-house eDiscovery, a strategy that ended up being Guidance’s main force of growth leading to our IPO in 2006. So after leaving in 2009 and engaging in consulting projects through 2010 I began discussions with X1, an Idealab Company that I always thought had excellent search technology for both the desktop and the enterprise... FBI: We need wiretap-ready Web sites - now

Wed, 05/16/2012 - 21:12

The FBI is asking Internet companies not to oppose a controversial proposal that would require firms, including Microsoft, Facebook, Yahoo, and Google, to build in backdoors for government surveillance. In meetings with industry representatives, the White House, and U.S. senators, senior FBI officials argue the dramatic shift in communication from the telephone system to the Internet has made it far more difficult for agents to wiretap Americans suspected of illegal activities, CNET has learned... Interview with Noreen Tehrani, Applied Trauma Psychologist, NTA

Tue, 05/15/2012 - 21:45

What are the short and long term effects of working with the kind of disturbing material which digital forensics examiners often encounter in their work? I think that it is relatively easy to see that some people will never be able to deal with the distressing images, sounds and dialogue that are part of the examiners world. Some people fail within the first few days of being exposed to the material. However, perhaps more difficult is the slow grinding down of the digital examiner's resilience which can happen over months or years. People who have handled this kind of work may suddenly find that they are unable to deal with it any more. I think that most people have a “shelf-life” for dealing with the most distressing material and need to take a break. The initial reaction to distressing material is the shock and disgust it causes, the fact that people will do things that most of us could never imagine. This is particularly distressing when the victim is a child... Read more

New York High Court Rules On CP In Browser Cache

Fri, 05/11/2012 - 03:07

Accessing and viewing child pornography over the internet is not necessarily a crime under New York law, the state’s highest court ruled Tuesday. The unanimous court said that child porn stored in a computer’s browser cache is not enough evidence to convict someone for child-porn possession under state law. The New York Court of Appeals ruled that the authorities, under New York’s child-porn statutes, must prove that an internet surfer knew that his computer automatically stored cached images, or printed or downloaded the images... There's no 911 for cybercrime. If there were, would you call?

Tue, 05/08/2012 - 19:36

If you work for a large corporation, you hear lots of talk about corporate responsibility, and that's great. But I can't help but point out that, whether it is intentional, there is a massive and growing hypocrisy in the corporate world when it comes to prosecuting crime...it's anecdotally clear that most companies simply don't call the authorities when they experience criminal losses through online attacks. We in the industry know this, but I wonder if the assumptions we make as to why this is so are correct. It's especially important to consider this now, as we're in the middle of what can only be called a "conversion convergence" which continues to see increases in use of the Internet to monetize stolen information and to launder ill-gotten gains... Review: 'Digital Forensics for Legal Professionals'

Fri, 05/04/2012 - 18:37

Authors Larry and Lars Daniel have assembled a nearly perfect book: "Digital Forensics for Legal Professionals: Understanding Digital Evidence From the Warrant to the Courtroom" is a reference manual, instruction guide, and a best practices and lessons-learned archive that's essential reading for legal professionals working with digital evidence. The topics covered in the book are designed efficiently and easily absorbed, with technical and legal concepts articulated by real-world examples. Technical concepts, such as HASH values, metadata, file carving, and thumbnail caches are simplified. Laws and acts, including civil and criminal proceedings, the Adam Walsh Child Protection and Safety Act of 2006, rules of discovery, and orders are explained clearly enough for non-lawyers to understand...
